This study deals with the controversial issue of parallel imports, especially in terms of the recent WTO TRIPS related discussions. Parallel imports refers to goods protected by intellectual property rights that are imported through unlicensed parties, without the knowledge or consent of the original rights holders. Whether parallel imports infringes upon the rights of original patent or trademark depends on the regime of exhaustion of rights. Those who argue for international exhaustion, and therefore the allowance of parallel imports, emphasize the need for free movement of goods in today's world economy which is increasingly becoming integrated, while those who argue for national exhaustion points to the territorially based nature of intellectual property rights, especially that of patents. They argue that the right holder must have control over distribution of the goods protected by intellectual property rights in each national territory, including blocking parallel imports, without being affected by whether the right has been exhausted elsewhere.
